Resumen

La Directiva 2011/83/UE establece el régimen de de ejercicio del derecho de desistimiento en los arts. 9 a 16, aplicables conjuntamente a los contratos a distancia y a los celebrados fuera del establecimiento. En dichos preceptos se contemplan  aspectos relativos a las condiciones de ejercicio del mencionado derecho: plazo, forma, efectos, obligaciones del consumidor y del comerciante y excepciones al ejercicio del mismo. Muchos de esos aspectos difieren de los previstos actualmente en el Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios de 2007 (TRLGDCU), de manera que la transposición de la Directiva a nuestro derecho interno, exigirá la reforma de los mismos. El objeto de este trabajo es resaltar, en primer lugar, las novedades que la nueva Directiva introduce respecto al ejercicio del derecho de desistimiento con relación al previsto en el TRLGDCU. En segundo lugar, se expone el régimen de ejercicio del desistimiento que establece la Directiva. Por último, se incorpora un anexo comparativo de la regulación del derecho de desistimiento en la nueva Directiva y en el TRLGDCU.

Title: The right of withdrawal in the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights

Abstract: Articles 9 to 16 of the new Directive 2011/83/UE contain the rules for exercising the right of withdrawal, which are applicable to distance contracts and contracts negotiated away from business premises. The articles deal with the following aspects that are related to the right mentioned: terms, forms, purpose, obligations of the consumer and the trader as well as exceptions to be exercised. Many of these aspects differ from current provisions of the Revised General Act for the Protection of Consumers and Users, 2007 (TRLGDCU). The transformation of the Directive into our national law requires a process of adaptation and reform. The aim of this paper is first, to highlight the new aspects that are introduced by the Directive referring the exercise of right of withdrawal compared to the rights that form part of the TRLGDCU. Second, we shall discuss the exercise of the right of withdrawal established by the Directive. Finally, a comparative annex on the regulation of the right of withdrawal in the new Directive and the TRLGDCU will be included.
