Abstract

The STS (1st Chamber) 1200/2023, of July 21, issued in connection with the damages caused by thalidomide, deals with the dies a quo of the action for compensation for damages. The decision fully assumes the subjective criterion for determining the dies a quo, linked to the creditor's potential knowledge of the facts on which the action for damages is based. This is a very important ruling, since it relates the commencement of the limitation period to the diligence and good faith of the parties, the creditor's consultation of experts or public registry and the fraudulent concealment by the debtor of the facts on which the claim is based.
