Abstract

The CJEU judgment of 30 October 2025 (Case C-143/23) analyses whether German legislation on withdrawal from consumer credit agreements, commencement of the withdrawal period and effects of such withdrawal on the sales contract when the sale and credit are linked contracts, is in accordance with Article 14 of Directive 2008/48/EC of 23 April on consumer credit agreements. The effects of this judgment on Spanish law are also examined.
