What happened to the floor clauses? Analysis of recent Supreme Court judgment

Abstract

The litigation regarding the floor clause seems outdated. However, there are still recent decisions of the Supreme Court that rule on the issue, and not always, as we might think, are favorable to consumers. The purpose of this article is to analyze some of the latest jurisprudential decisions, as a survey, to determine the current state of the matter. The aim is to analyze the basis of a set of decisions recently issued by the High Court: estimates of the nullity of the floor clause due to lack of transparency; and others that declare their validity because they understand that they exceed the transparency control.
