Abstract

The Spanish Supreme Court judgment 643/2022 of 4.5.2022 (Star I) rejected that a card with an APR of 24.5% was usurious since the rates applied to similar operations at the time of contracting ranged between 23 and 26%. The Spanish Supreme Court issued a press release and an explanatory order explaining that this did not entail a change in doctrine because it was limited to accepting the facts established in the instance. However, the Spanish Supreme Court judgment of 4.10.2022 (Estrella II), reiterates this criterion even though it was not mentioned in the previous instances. In addition, the Spanish Supreme Court judgment 662/2022 of 10.13.2022 does not alter this change of criteria in any way since it does not question the usurious nature of the credit card, which became res iudicata on appeal as it was not appealed by the parties.
