An APR of 26% in a revolving credit is within the normal interest rate of money, and a higher APR is only usurious if it is "significantly higher" than that figure
Main Article Content
Abstract
The STS (Sala 1ª) 43/2022, of October 4, establishes that an APR of 23% to 26% in a revolving credit granted between 1999 and 2009 is a usual APR at that time for this type of credit. This paper examines the scope of this doctrine. It also analyzes how to calculate the "normal interest on money" of a revolving credit granted from 2011, and the role that the statistics published by the Bank of Spain play at this point.
