Contractual information (but not pre-contractual information) as a decisive element for the material transparency of revolving credit: case law of the Provincial Courts

Abstract
The Provincial Courts have handed down hundreds of judgments on the control of the material transparency of the remunerative interest clause of the revolving credit. In view of the doctrine established by the CJEU and the Supreme Court, it can be argued that the decisive element for judging material transparency is the information contained in the contract itself, and not the pre-contractual information that may have been provided by the lender. This paper examines the viability of this thesis and analyses the extent to which it has been accepted by the Provincial Courts.
