Abstract

This comment analyzes the STS (Civil Chamber, 1st section), no. 161/2024 of February 7, which deals with a case of liability for defective products; in particular, a hip prosthesis. According to the TRLGDCU, liability for defective products expires after ten years from the date the product was put into circulation. This period applies even in situations where the manufacturer has not been identified and liability rests with the product supplier.
