Comments on the provisions concerning consumer law contained in Royal Decree-Law 6/2023, of December 19

Abstract
Royal Decree-Law 6/2023 has made important amendments to the Law on Civil Procedure in the area of consumer law. This paper analyses the new provisions with a particular focus on those that have affected the review of the court’s own motion on the unfairness of contractual terms in the summary procedure for the recovery of lawyers’ and procurators’ fees, in the enforcement proceedings and in the order for payment procedure, as well as the ex officio adoption of interim measures.
Its examination, in the light of the doctrine of the Court of Justice of the European Union, reveals the possible incompatibility with Directive 93/13 on unfair terms of some of these new provisions, leading, in short, to a disappointing result that suggests that new references for a preliminary ruling will be submitted. Given this eventual incompatibility, the author also proposes alternative texts for some of these provisions, which, in his view, would comply with the conditions laid down by the case-law of the CJEU.
