Abstract

The Court of Justice of the European Union, in its ruling of July 9, 2024, in the joint cases C-771/22 and C-45/23, has established that travelers are entitled to the protection against the insolvency of the organizer of package travel, even if the extraordinary circumstances occurred before the organizer's insolvency. In summary, if a traveler cancels their trip due to unavoidable and extraordinary circumstances, and the organizer subsequently becomes insolvent, the traveler still has the right to the protection provided by the guarantee. This applies as long as the traveler has not received a full refund before the insolvency occurred.
