Practical importance of the classification of several infractions as several serious ones or as a single continuous infringement for quantifying the penalty

Abstract
The objective of this paper is to underline the practical importance of the distinction between several successive serious infringements and a single continuous infringement. For this, the SAN, of 13th of April 2022 (JUR 2022, 167636) is analyzed, which deals with the appeal filed by ENDESA, S.A against the National Commission of Markets and Competition that condemned it to pay 300, 000 euros for making three serious infractions. The key point of the matter is to consider whether the principle of proportionality has been violated by considering these infractions as three serious ones and not as a single continuous infraction.
